도시가스사업법 제45조(권한의 위임ㆍ위탁)

City Gas Business Act, Article 45 (Delegation and Entrustment of Authority)

① 이 법에 따른 산업통상부장관 또는 시ㆍ도지사의 권한은 그 일부를 대통령령으로 정하는 바에 따라 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 위임할 수 있다. <개정 2008.2.29, 2013.3.23, 2025.10.1>

② 이 법에 따른 산업통상부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장의 권한 중 다음 각 호의 업무는 대통령령으로 정하는 바에 따라 한국가스안전공사에 위탁할 수 있다. 다만, 제5호의 업무는 중대한 위해(危害)가 발생하였거나 위해의 발생이 긴박하여 긴급하고 부득이하다고 인정할 때에만 위탁할 수 있다. <개정 2008.2.29, 2010.1.27, 2013.3.23, 2016.1.6, 2025.10.1>

③ 이 법에 따른 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장의 권한 중 제17조제1항 본문에 따른 특정가스사용시설에 대한 정기검사에 관한 업무는 대통령령으로 정하는 바에 따라 한국가스안전공사 또는 「고압가스 안전관리법」 제35조에 따른 검사기관에 위탁할 수 있다.
