도로법 시행령 제85조(국가지원지방도 및 대도시권 교통혼잡도로에 대한 비용의 지원)

① 법 제86조제2항에 따른 국가지원지방도(법 제15조제2항에 따라 지정ㆍ고시한 국가지원지방도를 말한다. 이하 "국가지원지방도"라 한다)의 건설에 필요한 비용은 제84조제1항 각 호에 해당하는 공사비와 보상비로 한다.

② 법 제86조제2항에 따른 국가지원지방도의 보수, 유지ㆍ관리에 필요한 비용은 해당 도로를 보수, 유지ㆍ관리하는 데에 드는 비용 중에서 다음 각 호의 비용을 제외한 비용으로 한다.

③ 국가지원지방도의 건설에 필요한 비용 중 공사비는 법 제86조제2항에 따라 국고에서 보조하며, 국가지원지방도의 건설에 필요한 비용 중 보상비가 100분의 30을 초과하는 경우에는 예산의 범위에서 초과하는 비용의 일부를 국고에서 보조할 수 있다.

④ 도로관리청이 속하는 지방자치단체의 재정형편이 곤란하여 국가의 지원으로 건설된 구간의 보수, 유지ㆍ관리에 지장이 있다고 인정되는 경우에는 예산의 범위에서 국가지원지방도의 보수, 유지ㆍ관리에 필요한 비용의 일부를 국고에서 보조할 수 있다.

⑤ 법 제31조제3항 단서에 따라 특별시장 또는 광역시장이 국가지원지방도의 조사ㆍ설계를 실시하는 경우 그 조사ㆍ설계에 관한 비용은 국고에서 부담한다.

⑥ 법 제86조제2항에 따라 대도시권 교통혼잡도로의 개선을 위한 세부 사업계획을 시행하는 데에 드는 비용의 일부를 지원할 때에는 예산의 범위에서 제84조제1항제1호에 따른 공사비(조사ㆍ설계에 드는 비용을 포함한다)를 지원할 수 있다.
