댐 주변지역 친환경 보전 및 활용에 관한 특별법 제13조(타인의 토지에의 출입 등)

① 사업시행자는 실시계획의 작성 등을 위한 조사ㆍ측량 또는 댐 친환경 활용 사업의 시행을 위하여 필요한 경우에는 타인이 소유하거나 점유하는 토지에 출입하거나 타인이 소유하거나 점유하는 토지를 재료적치장ㆍ임시통로 또는 임시도로로 일시 사용할 수 있으며, 특히 필요한 경우에는 나무ㆍ흙ㆍ돌, 그 밖의 장애물을 변경하거나 제거할 수 있다. 이 경우 토지의 소유자 또는 점유자는 정당한 사유 없이 이를 방해하거나 거부할 수 없다.

② 제1항에 따라 타인의 토지에 출입하는 경우에는 미리 해당 토지의 소유자 또는 점유자에게 통지하여야 하며, 일시 사용 또는 장애물을 변경ㆍ제거하려는 경우에는 토지 소유자 또는 점유자의 동의를 받아야 한다. 다만, 해당 토지의 소유자 또는 점유자의 부재나 주소불명 등으로 동의를 받을 수 없는 때에는 행정청인 사업시행자는 관할 시장ㆍ군수ㆍ구청장에게 그 사실을 통지하여야 하며, 행정청이 아닌 사업시행자는 미리 관할 시장ㆍ군수ㆍ구청장의 허가를 받아 출입하여야 한다.

③ 해뜨기 전 또는 해진 후에는 해당 토지의 소유자 또는 점유자의 승낙 없이 택지 또는 담으로 둘러싸인 타인의 토지에 출입할 수 없다.

④ 제1항에 따라 타인의 토지에 출입하려는 자는 기후에너지환경부령으로 정하는 바에 따라 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 한다. <개정 2020.12.8, 2025.10.1>

⑤ 사업시행자는 제10조에 따른 실시계획의 승인을 받은 때에는 댐 친환경 활용 사업이 예정된 공유수면에 출입하거나 이를 일시 사용할 수 있다. 이 경우 「수산업법」 등 다른 법률에 따라 공유수면에 대한 권리를 가진 자의 동의를 받아야 하며, 그 권리를 가진 자는 정당한 사유 없이 해당 수면에 대한 사업시행자의 출입 또는 일시 사용을 방해하거나 거부할 수 없다.
