대한민국과 아메리카합중국 간의 상호방위조약 제4조에 의한 시설과 구역 및 대한민국에서의 합중국 군대의 지위에 관한 협정의 시행에 관한 민사특별법 제2조(국가의 배상 책임)

① 대한민국에 주둔하는 아메리카합중국 군대(이하 "합중국 군대"라 한다)의 구성원, 고용원 또는 합중국 군대에 파견 근무하는 대한민국의 증원군대 구성원이 그 직무를 수행하면서 대한민국에서 대한민국 정부 외의 제3자에게 손해를 입힌 경우에는 「국가배상법」에 따라 국가가 그 손해를 배상하여야 한다.

② 제1항은 합중국 군대 또는 합중국 군대에 파견 근무하는 대한민국의 증원군대가 점유ㆍ소유 또는 관리하는 토지의 공작물(工作物)과 그 밖의 시설 또는 물건의 설치나 관리의 하자로 인하여 대한민국 정부 외의 제3자에게 손해를 입힌 경우에도 적용한다.
