대통령기록물 관리에 관한 법률 시행령 제10조의5(전직 대통령 등에 대한 사본 또는 복제물의 제공)

① 전직 대통령, 평시대리인 또는 유고시대리인등이 같은 조 제1항제3호에 따른 열람 등을 하려는 경우에는 대통령기록관의 장이 정하는 열람신청서를 대통령기록관의 장에게 제출해야 한다. 이 경우 평시대리인은 대리 권한을 증명하는 서면을 대통령기록관의 장에게 제출해야 한다. <개정 2023.8.8>

② 대통령기록관의 장은 유고시대리인등이 제1항에 따라 법 제18조제1항제3호에 따른 열람 등을 신청하는 경우에는 이 영 제10조의7에 따라 열람 등이 가능한 대통령기록물을 지체 없이 유고시대리인등이 열람 등을 할 수 있도록 해야 한다. 다만, 대통령지정기록물의 경우에는 전문위원회의 심의를 거쳐 열람신청서를 제출받은 날부터 30일 이내에 법 제18조제1항제3호에 따른 열람 등의 가능 여부를 통보해야 하며, 전문위원회의 심의 등에 필요한 경우 30일의 범위에서 한차례만 그 기간을 연장할 수 있다. <신설 2023.8.8>

③ 대통령기록관의 장은 법 제18조제1항제3호에 따라 전직 대통령, 평시대리인 또는 유고시대리인등에게 대통령지정기록물 또는 비밀기록물의 사본 또는 복제물을 제공하는 경우에는 그 제공 상대방과 사본 또는 복제물의 제공 방법, 제공 기간 및 관리방안 등을 미리 협의하여 정해야 한다. <개정 2023.8.8>

⑤ 대통령기록관의 장은 제4항에 따라 대통령지정기록물 또는 비밀기록물의 사본 또는 복제물을 반납받은 경우에는 이를 즉시 폐기해야 한다. <개정 2023.8.8>
