대일항쟁기 강제동원 피해조사 및 국외강제동원 희생자 등 지원에 관한 특별법 제17조(위원의 제척ㆍ기피ㆍ회피)
Special Act on Investigation of Forced Mobilization Damage under Japanese Colonial Rule and Support for Victims, etc. of Forced Mobilization Overseas, Article 17 (Exclusion, Challenge, and Recusal of Members)
① 위원은 다음 각 호의 어느 하나에 해당하는 경우에는 해당 심의ㆍ결정에서 제척된다.
(1) A member is excluded from the deliberation and decision concerned in any of the following cases:
1. 위원 또는 그 배우자나 배우자이었던 자가 위로금등의 지급 신청을 한 경우
1. Where the member, or his or her spouse or former spouse, has applied for payment of consolation payments, etc.;
2. 위원이 위로금등의 지급 신청인과 친족이거나 친족이었던 경우
2. Where the member is or was a relative of an applicant for payment of consolation payments, etc.;
3. 위원이 위로금등 지급 신청에 관하여 당사자의 대리인으로 관여하거나 관여하였던 경우
3. Where the member is or was involved as an agent of a party in an application for payment of consolation payments, etc.
② 위로금등의 지급 신청인은 위원에게 심의ㆍ결정의 공정성을 기대하기 어려운 사정이 있는 경우 위원회에 위원의 기피를 신청할 수 있다.
(2) An applicant for payment of consolation payments, etc. may apply to the Committee for challenge of a member if there are circumstances in which fairness of deliberation and decision cannot be expected from the member.
③ 위원 본인은 제1항 각 호의 어느 하나 또는 제2항의 사유에 해당하는 경우에는 스스로 위원회의 심의ㆍ결정을 회피할 수 있다.
(3) A member may voluntarily recuse himself or herself from deliberation and decision by the Committee where the member falls under any subparagraph of paragraph (1) or the grounds under paragraph (2).
