대부업 등의 등록 및 금융이용자 보호에 관한 법률 시행령 제2조의8(대부업등의 교육)
Enforcement Decree of the Act on Registration of Credit Business and Protection of Finance Users, Article 2-8 (Education on Credit Business, etc.)
① 법 제3조의4제1항 단서에서 "대통령령으로 정하는 부득이한 사유"란 다음 각 호의 어느 하나의 사유를 말한다.
(1) The term "unavoidable grounds prescribed by Presidential Decree" in the proviso to Article 3-4 (1) of the Act means any of the following grounds:
1. 천재지변
1. A natural disaster;
2. 본인의 질병ㆍ사고, 업무상 국외 출장 등 부득이한 사유
2. Unavoidable grounds, such as the person's own illness or accident or an overseas business trip;
3. 교육기관의 인적ㆍ물적 사정 등으로 교육을 받기 어려운 경우
3. Cases where it is difficult to receive education due to the personnel or physical circumstances of the educational institution, etc.
② 법 제3조의4제1항 단서에서 "대통령령으로 정하는 기간" 이란 1개월을 말한다. <개정 2016.7.6>
(2) The term "period prescribed by Presidential Decree" in the proviso to Article 3-4 (1) of the Act means one month.
③ 법 제3조의4제1항에 따른 대부업등의 준수사항 등에 관한 교육은 시ㆍ도지사등이 다음 각 호의 구분에 따른 대부업자등의 임직원을 대상으로 실시한다. <개정 2018.11.13>
(3) Education on matters to be observed in credit business, etc. under Article 3-4 (1) of the Act shall be provided by the Si/Do Governor, etc. to the officers and employees of credit business operators, etc. according to the following classification:
1. 법 제3조제1항에 따라 대부업등의 등록을 하거나 해당 등록을 법 제3조의2제1항에 따라 갱신하려는 경우: 다음 각 목의 구분에 따른 사람
1. Where a person intends to register credit business, etc. under Article 3 (1) of the Act or to renew such registration under Article 3-2 (1) of the Act: the persons according to the following classification:
가. 법인인 대부업자등의 지점: 해당 지점의 업무를 총괄하는 사용인(이하 "업무총괄 사용인"이라 한다)
(a) For a branch of a credit business operator, etc. that is a corporation: the employee who supervises the business of the branch (hereinafter referred to as the "business-supervising employee");
나. 가목 외의 자: 대표자와 업무총괄 사용인
(b) For persons other than those in item (a): the representative and the business-supervising employee;
2. 법 제3조제2항에 따라 대부업등의 등록을 하거나 해당 등록을 법 제3조의2제1항에 따라 갱신하려는 경우: 다음 각 목의 구분에 따른 사람
2. Where a person intends to register credit business, etc. under Article 3 (2) of the Act or to renew such registration under Article 3-2 (1) of the Act: the persons according to the following classification:
가. 법인인 대부업자등의 지점: 해당 지점의 업무총괄 사용인
(a) For a branch of a credit business operator, etc. that is a corporation: the business-supervising employee of the branch;
나. 가목 외의 자: 다음의 사람
(b) For persons other than those in item (a): the following persons:
1) 대표자와 업무총괄 사용인
1) The representative and the business-supervising employee;
2) 임직원 총원(대표자 및 업무총괄 사용인을 포함한다)의 100분의 10 이상에 해당하는 수의 임직원
2) Officers and employees numbering at least 10 percent of the total number of officers and employees (including the representative and the business-supervising employee).
④ 제3항에 따른 교육의 내용은 다음 각 호와 같다. <신설 2018.11.13>
(4) The content of the education under paragraph (3) is as follows:
1. 법 제8조에 따른 대부업자의 이자율 제한 및 이자율 계산 방법
1. Restrictions on interest rates and the method of calculating interest rates of credit business operators under Article 8 of the Act;
2. 법 제12조제9항에 따른 보고서 작성 방법
2. The method of preparing reports under Article 12 (9) of the Act;
3. 「채권의 공정한 추심에 관한 법률」에 따른 불법적 채권추심행위의 금지
3. Prohibition of illegal debt collection practices under the Fair Debt Collection Practices Act;
4. 대부업자등의 광고에 관한 방법
4. Methods of advertising by credit business operators, etc.;
5. 그 밖에 대부업자등이 대부업등을 경영하는 데 필요하다고 판단되는 사항
5. Other matters deemed necessary for credit business operators, etc. to operate credit business, etc.
⑤ 시ㆍ도지사등은 제3항에 따른 교육을 받은 사람에게 금융위원회가 정하여 고시하는 교육이수증을 교부하여야 한다. <개정 2016.7.6, 2018.11.13>
(5) The Si/Do Governor, etc. shall issue an education completion certificate publicly notified by the Financial Services Commission to a person who has received the education under paragraph (3).
