대리점거래의 공정화에 관한 법률 시행령 제19조의2(포상금의 지급)

① 법 제26조의2제1항에 따른 포상금(이하 이 조에서 "포상금"이라 한다)의 지급대상이 되는 위반행위는 법 제6조부터 제12조까지의 어느 하나에 해당하는 규정을 위반하는 행위로 한다.

② 포상금은 제1항의 위반행위를 신고하거나 제보하고, 이를 입증할 수 있는 증거자료를 최초로 제출한 자에게 지급한다. 다만, 해당 위반행위를 한 공급업자 및 그 공급업자의 임직원으로서 해당 위반행위에 관여한 사람은 제외한다. <개정 2018.12.18>

③ 공정거래위원회는 특별한 사정이 있는 경우를 제외하고는 신고 또는 제보된 행위가 법 위반행위에 해당한다고 인정하여 해당 행위를 한 공급업자에게 시정조치 등의 처분을 하기로 의결한 날(이의신청이 있는 경우에는 재결한 날을 말한다)부터 3개월 이내에 포상금을 지급한다.

④ 포상금의 지급에 관여한 조사공무원은 신고자 또는 제보자의 신원 등 신고 또는 제보와 관련된 사항을 타인에게 제공하거나 누설해서는 아니 된다.

⑤ 위반행위의 유형별 구체적인 포상금 지급기준은 위반행위의 중대성 및 증거의 수준 등을 고려하여 공정거래위원회가 정하여 고시한다.

⑥ 포상금의 지급에 관한 사항을 심의하기 위하여 공정거래위원회에 신고포상금 심의위원회를 둘 수 있다.

⑦ 제6항에 따른 신고포상금 심의위원회의 설치ㆍ운영에 관한 사항 및 그 밖에 포상금 지급의 기준ㆍ절차 등에 관한 세부사항은 공정거래위원회가 정하여 고시한다.
