다중이용업소의 안전관리에 관한 특별법 제9조(다중이용업소의 안전관리기준 등)

① 다중이용업주 및 다중이용업을 하려는 자는 영업장에 대통령령으로 정하는 안전시설등을 행정안전부령으로 정하는 기준에 따라 설치ㆍ유지하여야 한다. 이 경우 다음 각 호의 어느 하나에 해당하는 영업장 중 대통령령으로 정하는 영업장에는 소방시설 중 간이스프링클러설비를 행정안전부령으로 정하는 기준에 따라 설치하여야 한다. <개정 2014.1.7, 2014.11.19, 2017.7.26>

② 소방본부장이나 소방서장은 안전시설등이 행정안전부령으로 정하는 기준에 맞게 설치 또는 유지되어 있지 아니한 경우에는 그 다중이용업주에게 안전시설등의 보완 등 필요한 조치를 명하거나 허가관청에 관계 법령에 따른 영업정지 처분 또는 허가등의 취소를 요청할 수 있다. <개정 2013.3.23, 2014.11.19, 2016.1.27, 2017.7.26>

③ 다중이용업을 하려는 자(다중이용업을 하고 있는 자를 포함한다)는 다음 각 호의 어느 하나에 해당하는 경우에는 안전시설등을 설치하기 전에 미리 소방본부장이나 소방서장에게 행정안전부령으로 정하는 안전시설등의 설계도서를 첨부하여 행정안전부령으로 정하는 바에 따라 신고하여야 한다. <개정 2013.3.23, 2014.1.7, 2014.11.19, 2015.1.20, 2017.7.26>

④ 소방본부장이나 소방서장은 제3항제1호 및 제2호에 따라 신고를 받았을 때에는 설계도서가 행정안전부령으로 정하는 기준에 맞는지를 확인하고, 그에 맞도록 지도하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

⑤ 소방본부장이나 소방서장은 제3항제3호에 따라 공사완료의 신고를 받았을 때에는 안전시설등이 행정안전부령으로 정하는 기준에 맞게 설치되었다고 인정하는 경우에는 행정안전부령으로 정하는 바에 따라 안전시설등 완비증명서를 발급하여야 하며, 그 기준에 맞지 아니한 경우에는 시정될 때까지 안전시설등 완비증명서를 발급하여서는 아니 된다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

⑥ 법률 제9330호 다중이용업소의 안전관리에 관한 특별법 일부개정법률 부칙 제3항에 따라 대통령령으로 정하는 숙박을 제공하는 형태의 다중이용업소의 영업장으로서 2009년 7월 8일 전에 영업을 개시한 후 영업장의 내부구조ㆍ실내장식물ㆍ안전시설등 또는 영업주를 변경한 사실이 없는 영업장을 운영하는 다중이용업주가 제1항 후단에 따라 해당 영업장에 간이스프링클러설비를 설치하는 경우 국가와 지방자치단체는 필요한 비용의 일부를 대통령령으로 정하는 바에 따라 지원할 수 있다. <신설 2020.6.9>
