Farmland Act, Article 36 (Permission for Temporary Use of Farmland for Other Purposes)

①농지를 다음 각 호의 어느 하나에 해당하는 용도로 일시 사용하려는 자는 대통령령으로 정하는 바에 따라 일정 기간 사용한 후 농지로 복구한다는 조건으로 시장ㆍ군수 또는 자치구구청장의 허가를 받아야 한다. 허가받은 사항을 변경하려는 경우에도 또한 같다. 다만, 국가나 지방자치단체의 경우에는 시장ㆍ군수 또는 자치구구청장과 협의하여야 한다. <개정 2018.12.24, 2024.1.2, 2026.3.17>

가. 「공유수면 관리 및 매립에 관한 법률」 제2조에 따른 공유수면매립을 통하여 조성한 토지 중 토양 염도가 일정 수준 이상인 지역 등 농림축산식품부령으로 정하는 지역에 설치하는 시설일 것

②시장ㆍ군수 또는 자치구구청장은 주무부장관이나 지방자치단체의 장이 다른 법률에 따른 사업 또는 사업계획 등의 인가ㆍ허가 또는 승인 등과 관련하여 농지의 타용도 일시사용 협의를 요청하면, 그 인가ㆍ허가 또는 승인 등을 할 때에 해당 사업을 시행하려는 자에게 일정 기간 그 농지를 사용한 후 농지로 복구한다는 조건을 붙일 것을 전제로 협의할 수 있다.

③시장ㆍ군수 또는 자치구구청장은 제1항에 따른 허가를 하거나 제2항에 따른 협의를 할 때에는 대통령령으로 정하는 바에 따라 사업을 시행하려는 자에게 농지로의 복구계획을 제출하게 하고 복구비용을 예치하게 할 수 있다. 이 경우 예치된 복구비용은 사업시행자가 사업이 종료된 후 농지로의 복구계획을 이행하지 않는 경우 복구대행비로 사용할 수 있다. <개정 2018.12.24>

④ 시장ㆍ군수ㆍ자치구구청장은 제1항 및 제2항에 따라 최초 농지의 타용도 일시사용 후 목적사업을 완료하지 못하여 그 기간을 연장하려는 경우에는 대통령령으로 정하는 바에 따라 복구비용을 재산정하여 제3항에 따라 예치한 복구비용이 재산정한 복구비용보다 적은 경우에는 그 차액을 추가로 예치하게 하여야 한다. <신설 2018.12.24>
