농지법 제23조(농지의 임대차 또는 사용대차)

1. 제6조제2항제1호ㆍ제4호부터 제9호까지ㆍ제9호의2 및 제10호의 규정에 해당하는 농지를 임대하거나 무상사용하게 하는 경우

4. 60세 이상인 사람으로서 대통령령으로 정하는 사람이 소유하고 있는 농지 중에서 자기의 농업경영에 이용한 기간이 5년이 넘은 농지를 임대하거나 무상사용하게 하는 경우

5. 제6조제1항에 따라 개인이 소유하고 있는 농지 중 3년 이상 소유한 농지를 주말ㆍ체험영농을 하려는 자에게 임대하거나 무상사용하게 하는 경우, 또는 주말ㆍ체험영농을 하려는 자에게 임대하는 것을 업(業)으로 하는 자에게 임대하거나 무상사용하게 하는 경우

5의2. 제6조제1항에 따라 농업법인이 소유하고 있는 농지를 주말ㆍ체험영농을 하려는 자에게 임대하거나 무상사용하게 하는 경우

7. 다음 각 목의 어느 하나에 해당하는 농지를 한국농어촌공사나 그 밖에 대통령령으로 정하는 자에게 위탁하여 임대하거나 무상사용하게 하는 경우

8. 자경 농지를 농림축산식품부장관이 정하는 이모작을 위하여 8개월 이내로 임대하거나 무상사용하게 하는 경우

9. 대통령령으로 정하는 농지 규모화, 농작물 수급 안정 등을 목적으로 한 사업을 추진하기 위하여 필요한 자경 농지를 임대하거나 무상사용하게 하는 경우
