농업ㆍ농촌 공익기능 증진 직접지불제도 운영에 관한 법률 시행규칙 제38조(전략작물직접지불금 등록사항의 변경등록 등)

① 영 제46조제1항에 따라 등록사항을 변경등록하려는 자는 별지 제21호서식에 따른 전략작물직접지불금 지급대상자 변경등록신청서에 제34조제2항 각 호의 서류를 첨부하여 매년 농림축산식품부장관이 정하여 공고하는 날까지 농지 소재지를 관할하는 읍ㆍ면장에게 제출해야 한다. <개정 2023.3.21>

② 영 제46조제2항에 따라 지급대상 농지의 양수ㆍ임차 또는 사용차를 신고하려는 자는 별지 제8호서식에 따른 전략작물직접지불금 지급대상자 변경등록신고서에 다음 각 호의 서류를 첨부하여 매년 농림축산식품부장관이 정하여 공고하는 날까지 읍ㆍ면장에게 제출해야 한다. 다만, 읍ㆍ면장이 농업경영정보, 농지대장 또는 토지대장 등본 등으로 이를 확인할 수 있는 경우에는 첨부하지 않는다. <개정 2022.5.18, 2023.3.21>

③ 읍ㆍ면장은 제1항에 따른 변경등록의 신청을 받거나 제2항에 따른 신고를 받으면 그 신청서 또는 신고서에 영 제46조제3항 및 제4항에 따른 조사 및 심의결과를 첨부하여 시장ㆍ군수ㆍ구청장등에게 제출해야 한다.

④ 시장ㆍ군수ㆍ구청장등은 제3항에 따른 신청서ㆍ신고서 및 첨부서류를 제출받으면 변경사항을 확인한 후 변경사항에 이상이 없는 경우에는 전략작물직접지불금 지급대상자로 변경등록을 하고, 읍ㆍ면장을 거쳐 등록신청인 또는 신고인에게 등록증을 다시 발급해야 한다. <개정 2023.3.21>
