농어촌정비법 제108조(자금지원 등)

① 관계 중앙행정기관의 장과 지방자치단체의 장은 농어촌정비사업을 효율적으로 추진할 수 있도록 하기 위하여 필요한 사업비를 예산에 계상(計上)하여야 한다.

② 국가와 지방자치단체는 이 법에 따른 농어촌정비사업에 필요한 자금의 전부 또는 일부를 보조하거나 융자할 수 있다. <개정 2023.3.28>

③ 농어촌정비사업의 시행자는 사업 시행을 위탁한 경우 필요하다고 인정하면 제2항에 따라 지원받은 자금의 전부 또는 일부를 사업을 끝내기 전이라도 위탁 사업자에게 내줄 수 있다.

④ 국가와 지방자치단체는 제56조제1항제2호 및 제3호의 사업시행자가 제2조제10호가목 및 나목에 따른 새로운 농어촌마을 건설사업 또는 기존 농어촌마을의 재개발사업을 시행하는 데 필요한 자금의 전부 또는 일부를 보조할 경우, 사업 시행기간 내에 보조 대상 사업을 완료하지 못할 특별한 사유가 있거나 사업 목적 달성을 위하여 필요한 경우에는, 사업시행자와 계약을 체결하여 보조 대상 사업을 사업시행자 부담으로 시행하고, 그 비용을 사후에 상환할 수 있다.

⑤ 제4항에 따른 보조 대상 사업 비용의 상환방법과 절차 등에 필요한 사항은 대통령령으로 정한다.

⑥ 국가 및 지방자치단체는 제8조제1항 각 호 외의 부분 본문에 따라 농림축산식품부장관이 농업생산기반 정비사업 기본계획을 세우는 농업생산기반 정비사업 중 수혜면적이 30만제곱미터 이상 50만제곱미터 미만인 농업생산기반 정비사업에 대하여 필요한 비용을 분담하여야 한다. 이 경우 농림축산식품부장관은 제8조제1항 각 호 외의 부분 본문에 따른 농업생산기반 정비사업 기본계획 수립 시 관할 시ㆍ도지사와 협의하여야 한다. <신설 2026.3.10>
