농어촌도로 정비법 제18조의2(권리ㆍ의무의 승계 등)

① 제18조에 따른 도로의 점용허가를 받은 자의 사망, 그 지위의 양도, 합병이나 분할 등의 사유가 있으면 도로의 점용허가로 인하여 발생한 권리ㆍ의무는 다음 각 호의 구분에 따른 자가 승계한다.

② 제1항에 따라 권리나 의무를 승계한 자는 그 승계사유가 발생한 날부터 3개월 이내에 행정안전부령으로 정하는 바에 따라 그 사실을 군수에게 신고하여야 한다. <개정 2017.7.26>

③ 도로의 점용허가를 받은 자가 점용의 목적이 되는 토지나 건물의 소유권을 타인에게 양도한 경우에는 해당 도로의 점용허가에 따른 권리ㆍ의무도 함께 양도한 것으로 본다.
