농약관리법 제5조의2(행정처분 효과의 승계)

제5조제1항에 따른 지위의 승계가 있는 때에는 종전의 제조업자등 또는 수출입식물방제업자등에게 행한 제7조제1항부터 제3항까지의 규정에 따른 행정처분의 효과는 그 처분기간이 만료된 날부터 1년간 그 지위를 승계한 자에게 승계되며, 행정처분의 절차가 진행 중인 때에는 그 지위를 승계한 자에 대하여 그 절차를 계속 진행할 수 있다. 다만, 지위를 승계한 자가 그 지위의 승계 시에 그 행정처분 또는 위반사실을 알지 못하였음을 증명하는 때에는 그러하지 아니하다. <개정 2021.6.15>
