농수산자조금의 조성 및 운용에 관한 법률 시행령 제5조(대의원의 재선거 및 보궐선거)

① 의무자조금단체는 제4조에 따라 선출된 대의원 수가 선출구역별로 배정된 대의원 수보다 적은 경우에는 해당 선출구역에 대하여 재선거를 실시할 수 있다.

② 의무자조금단체는 제4조에 따라 선출된 대의원 중 결원(缺員)이 된 대의원의 수가 제4조제1항에 따른 전체 대의원 수의 100분의 10 이상인 경우에는 보궐선거를 실시하여야 한다.

③ 제1항에 따라 선출된 대의원의 임기는 재선거 실시 전에 실시한 선거로 선출된 대의원 임기의 남은 기간으로 하고, 제2항에 따라 선출된 대의원의 임기는 전임자 임기의 남은 기간으로 한다.

④ 제1항 및 제2항에 따른 재선거 및 보궐선거의 절차ㆍ방법 등에 대해서는 제3조 및 제4조를 준용한다.
