농수산자조금의 조성 및 운용에 관한 법률 시행령 제2조(정부 출연금 또는 지원금의 지급 등)

① 농림축산식품부장관 또는 해양수산부장관은 「세계무역기구 설립을 위한 마라케쉬협정」 부속서 1.가.의 「농업에 관한 협정」이 허용하는 범위 안에서 자조금단체가 조성한 거출금[의무농수산자조금을 설치한 자조금단체(이하 "의무자조금단체"라 한다)의 경우 「농수산자조금의 조성 및 운용에 관한 법률」(이하 "법"이라 한다) 제7조제3호에 따른 지원금을 포함한다] 중 법 제4조에 따라 해당 연도의 사업에 사용한 금액을 한도로 하여 법 제5조제1항에 따른 출연금 또는 지원금(이하 "출연금등"이라 한다)을 예산 내에서 지급한다. 이 경우 자조금단체의 대표성, 조직화 정도, 사업역량, 농수산자조금(이하 "자조금"이라 한다) 조성액 등을 고려하여 농림축산식품부장관 또는 해양수산부장관이 정하여 고시하는 기준에 따라 차등 지급할 수 있다. <개정 2013.3.23, 2018.4.24>

② 출연금등을 받으려는 자조금단체는 다음 각 호의 사항에 관한 서류를 갖추어 농림축산식품부장관 또는 해양수산부장관에게 출연금등의 지급 신청을 하여야 한다. <개정 2013.3.23>

③ 농림축산식품부장관 또는 해양수산부장관은 「보조금 관리에 관한 법률」 제17조제1항에 따라 출연금등 신청의 타당성 및 제2항에 따른 구비서류를 검토하여 출연금등의 지급을 결정하고 신청인에게 통지하여야 한다. <개정 2013.3.23>
