농수산물 품질관리법 제62조(출입ㆍ수거ㆍ조사 등)

① 식품의약품안전처장이나 시ㆍ도지사는 안전성조사, 제68조제1항에 따른 위험평가 또는 같은 조 제3항에 따른 잔류조사를 위하여 필요하면 관계 공무원에게 농수산물 생산시설(생산ㆍ저장소, 생산에 이용ㆍ사용되는 자재창고, 사무소, 판매소, 그 밖에 이와 유사한 장소를 말한다)에 출입하여 다음 각 호의 시료 수거 및 조사 등을 하게 할 수 있다. 이 경우 무상으로 시료 수거를 하게 할 수 있다. <개정 2013.3.23, 2022.2.3>

② 제1항에 따른 출입ㆍ수거ㆍ조사 또는 열람을 하고자 할 때는 미리 조사 등의 목적, 기간과 장소, 관계 공무원 성명과 직위, 범위와 내용 등을 조사 등의 대상자에게 알려야 한다. 다만, 긴급한 경우 또는 미리 알리면 증거인멸 등으로 조사 등의 목적을 달성할 수 없다고 판단되는 경우에는 현장에서 본문의 사항 등이 기재된 서류를 조사 등의 대상자에게 제시하여야 한다. <개정 2022.2.3>

④ 농수산물을 생산, 저장, 운반 또는 판매하는 자는 제1항에 따른 출입ㆍ수거ㆍ조사 또는 열람을 거부ㆍ방해하거나 기피하여서는 아니 된다. <신설 2022.2.3>
