농수산물 품질관리법 제13조(농산물우수관리 관련 보고 및 점검 등)

① 농림축산식품부장관은 농산물우수관리를 위하여 필요하다고 인정하면 우수관리인증기관, 우수관리시설을 운영하는 자 또는 우수관리인증을 받은 자로 하여금 그 업무에 관한 사항을 보고(「정보통신망 이용촉진 및 정보보호 등에 관한 법률」에 따른 정보통신망을 이용하여 보고하는 경우를 포함한다. 이하 같다)하게 하거나 자료를 제출(「정보통신망 이용촉진 및 정보보호 등에 관한 법률」에 따른 정보통신망을 이용하여 제출하는 경우를 포함한다. 이하 같다)하게 할 수 있으며, 관계 공무원에게 사무소 등을 출입하여 시설ㆍ장비 등을 점검하고 관계 장부나 서류를 조사하게 할 수 있다. <개정 2013.3.23>

② 제1항에 따라 보고ㆍ자료제출ㆍ점검 또는 조사를 할 때 우수관리인증기관, 우수관리시설을 운영하는 자 및 우수관리인증을 받은 자는 정당한 사유 없이 이를 거부ㆍ방해하거나 기피하여서는 아니 된다.

③ 제1항에 따라 점검이나 조사를 할 때에는 미리 점검이나 조사의 일시, 목적, 대상 등을 점검 또는 조사 대상자에게 알려야 한다. 다만, 긴급한 경우나 미리 알리면 그 목적을 달성할 수 없다고 인정되는 경우에는 알리지 아니할 수 있다.

④ 제1항에 따라 점검이나 조사를 하는 관계 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 하며, 성명ㆍ출입시간ㆍ출입목적 등이 표시된 문서를 관계인에게 내주어야 한다.
