농림식품과학기술 육성법 시행령 제15조의3(신기술 인증의 대상ㆍ기준ㆍ심사 및 절차 등)

Enforcement Decree of the Act on Fostering Agriculture, Forestry and Food Science and Technology, Article 15-3 (Subjects, Standards, Review, and Procedures of New Technology Certification, etc.)

① 법 제12조의2제1항에 따라 농림식품신기술(이하 "신기술"이라 한다)로 인증할 수 있는 대상은 신기술 인증 신청일을 기준으로 다음 각 호의 어느 하나에 해당하는 기술로 한다. <개정 2017.6.27>

1. 정립된 이론을 바탕으로 한 기술을 시작품(試作品) 등으로 제작 또는 생산하여 시험 또는 운영(이하 이 조에서 "실증화시험"이라 한다)함으로써 정량적 평가지표를 확보한 개발완료기술로서 향후 2년 이내에 상용화가 가능한 기술

3. 제품의 품질 및 안정성 면에서 개발 목표로 제시한 제품의 성능을 유지할 수 있는 품질경영체계를 갖추고 있을 것

③ 농림축산식품부장관은 법 제12조의2제3항에 따라 신기술 인증의 신청을 받은 경우에는 제1항의 인증 대상과 제2항의 인증 기준에 적합한지를 심사ㆍ평가하여야 한다. <개정 2017.6.27>

(3) Upon어판 receiving^r러시^v빙 an앤 application애플러케이션 for^f포 new누 technology텍날러지 certification서터^f퍼케이션 pursuant퍼수언트 to투 Article아터클 12-2 (3) of어^v브 the^ð디 Act,액트 the^ð더 Minister미너스터 of어^v브 Agriculture,애그^r리컬처 Food^f푸드 and앤드 Rural^r루^r럴 Affairs어^f페어즈 shall섈 review^r리^v뷰 and앤드 evaluate이^v밸류에잇 whether웨^ð더 the^ð더 technology텍날러지 conforms컨^f폼즈 to투 the^ð더 subjects서브직츠 of어^v브 certification서터^f퍼케이션 in인 paragraph패^r러그^r래^f프 (1) and앤드 the^ð더 certification서터^f퍼케이션 standards스탠더즈 in인 paragraph패^r러그^r래^f프 (2).

④ 농림축산식품부장관은 제3항에 따른 심사ㆍ평가 결과 적합하다고 인정되는 기술에 대하여 기술명, 기술보유자, 인증 예정 유효기간, 의견 제출 기간 및 방법을 포함한 신기술 인증 예정사실을 관보나 농림축산식품부장관이 지정하는 정보통신망에 공고하여야 한다. <개정 2017.6.27>

⑤ 제4항에 따라 공고된 신기술과 관련하여 이해관계가 있는 자는 공고일부터 30일 이내에 농림축산식품부장관에게 이의신청을 할 수 있다. <개정 2017.6.27>

⑥ 농림축산식품부장관은 제5항에 따른 이의신청을 받은 경우에는 이를 조사ㆍ검토한 후, 그 결과를 신청인과 이해관계인에게 알려야 한다. <개정 2017.6.27>
