노후거점산업단지의 활력증진 및 경쟁력강화를 위한 특별법 시행령 제22조(용도별 구역 변경 등에 따른 지가상승분의 기부)

① 법 제17조제2항에 따라 사업시행자가 기부받을 수 있는 지가상승분은 토지이용계획 또는 용도별 구역 변경 등에 따른 지가 차액의 100분의 50 이상으로서 전략계획수립권자가 정하여 고시한다.

② 토지이용계획 또는 용도별 구역 변경 전후의 지가 산정은 「산업집적활성화 및 공장설립에 관한 법률」 제33조제6항에 따른 산업단지관리기본계획의 변경 고시 전 3개월 이내의 범위에서 2인 이상의 감정평가법인등(「감정평가 및 감정평가사에 관한 법률」에 따른 감정평가법인등을 말한다)이 감정평가한 금액의 산술평균치로 한다. 다만, 사업계획에 「산업입지 및 개발에 관한 법률」 제39조의2제5항에 따른 재생계획이 포함된 경우에는 같은 법 제39조의7제5항에 따른 재생시행계획의 변경 고시 전 3개월 이내의 범위에서 본문과 동일한 방법으로 감정평가한 금액의 산술평균치로 한다. <개정 2016.2.11, 2016.8.31, 2020.5.12, 2022.1.21>
