노동조합 및 노동관계조정법 제72조(특별조정위원회의 구성)

①공익사업의 노동쟁의의 조정을 위하여 노동위원회에 특별조정위원회를 둔다.

②제1항의 규정에 의한 특별조정위원회는 특별조정위원 3인으로 구성한다.

③제2항의 규정에 의한 특별조정위원은 그 노동위원회의 공익을 대표하는 위원중에서 노동조합과 사용자가 순차적으로 배제하고 남은 4인 내지 6인중에서 노동위원회의 위원장이 지명한다. 다만, 관계 당사자가 합의로 당해 노동위원회의 위원이 아닌 자를 추천하는 경우에는 그 추천된 자를 지명한다. <개정 2006.12.30>
