법 제9조제2항에 따라 피해어업인의 재산상속인이 보상금의 지급을 신청할 때 같은 순위의 재산상속인이 2명 이상인 경우에는 별지 제1호의2서식의 상속대표자 선정서에 따라 그 같은 순위의 재산상속인 또는 그의 법정대리인 중에서 상속대표자를 선정해야 한다. 다만, 같은 순위의 재산상속인 또는 그의 법정대리인 간의 합의가 불가능한 경우에는 그렇지 않다.
