기초연구진흥 및 기술개발지원에 관한 법률 시행령 제16조(특정연구개발사업 참여기관 등의 기준)

① 법 제14조제1항제5호에서 "연구 인력ㆍ시설 등 대통령령으로 정하는 기준에 해당하는 비영리법인"이란 학사 이상의 학위를 소지한 사람으로서 3년 이상의 연구경력(학위 취득 전의 연구경력을 포함한다)을 가진 연구전담요원 3명 이상을 늘 확보하고 연구시설을 갖춘 비영리법인을 말한다. <개정 2016.9.22, 2022.8.9>

② 법 제14조제1항제6호에서 "연구 인력ㆍ시설 등 대통령령으로 정하는 기준에 해당하는 의료법인"이란 보건의료기술 분야에서 3년 이상의 연구경력을 가진 의료인 2명 이상과 보건의료기술 분야에서 3년 이상의 연구경력을 가진 연구전담요원 3명 이상을 늘 확보하고 연구시설을 갖춘 의료법인을 말한다. <개정 2016.9.22>

③ 법 제14조제1항제6호의2에서 "연구 인력 및 시설 등 대통령령으로 정하는 기준을 충족하는 기업"이란 사업주를 포함하여 1명 이상의 연구인력을 확보하고 연구시설을 갖춘 「1인 창조기업 육성에 관한 법률」 제2조에 따른 1인 창조기업을 말한다. <신설 2016.9.22>

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 특정연구개발사업 참여기관 등이 확보하여야 하는 연구전담요원의 자격기준은 과학기술정보통신부령으로 정한다. <개정 2013.3.23, 2016.9.22, 2017.7.26>
