① 금융위원회는 임원이 제30조의2를 위반하거나 대표이사등이 제30조의4를 위반하는 경우에는 제35조에 따른 조치(같은 조 제5항에 따른 조치는 제외한다)를 할 수 있다.

② 금융위원회는 제1항에 따라 조치를 하는 경우에는 다음 각 호의 사항을 고려하여 제재조치를 감경하거나 면제할 수 있다.
