군인의 지위 및 복무에 관한 기본법 제24조(명령 발령자의 의무)

① 군인은 직무와 관계가 없거나 법규 및 상관의 직무상 명령에 반하는 사항 또는 자신의 권한 밖의 사항에 관하여 명령을 발하여서는 아니 된다.

② 명령은 지휘계통에 따라 하달하여야 한다. 다만, 부득이한 경우에는 지휘계통에 따르지 아니하고 하달할 수 있고, 이 경우 명령자와 수명자는 이를 지체 없이 지휘계통의 중간지휘관에게 알려야 한다.

③ 명령의 하달은 신속ㆍ정확하게 이루어져야 한다.

④ 군인은 자신이 내린 명령의 이행 결과에 대하여 책임을 진다.
