군인사법 시행령 제60조의23(전사자등의 구분)

Enforcement Decree of the Military Personnel Act, Article 60-23 (Classification of Persons Killed in Action, etc.)

① 법 제54조의2제1항에 따른 전사자ㆍ순직자ㆍ일반사망자ㆍ전상자ㆍ공상자 및 비전공상자(이하 "전사자등"이라 한다)의 구분에 관한 기준은 다음 각 호와 같다. <개정 2020.8.4, 2022.6.30>

1. 법 제54조의2제1항제1호에 따른 전사자: 별표 7의 어느 하나에 해당하는 사망자

1. Persons퍼슨즈 killed킬드 in인 action액션 under언더 Article아터클 54-2 (1) 1 of어^v브 the^ð디 Act:액트 deceased디시스트 persons퍼슨즈 falling^f팔링 under언더 any에니 item아이텀 of어^v브 Attached어태치트 Table테이블 7;

2. 법 제54조의2제1항제2호에 따른 순직자

가. 순직Ⅰ형에 해당하는 순직자: 별표 8의 2-1-1부터 2-1-17까지의 어느 하나에 해당하는 사망자

나. 순직Ⅱ형에 해당하는 순직자: 별표 8의 2-2-1부터 2-2-7까지의 어느 하나에 해당하는 사망자

다. 순직Ⅲ형에 해당하는 순직자: 별표 8의 2-3-1부터 2-3-14까지의 어느 하나에 해당하는 사망자

3. 법 제54조의2제1항제3호에 따른 일반사망자: 별표 7 및 별표 8의 어느 하나에 해당하지 아니하는 사망자

6. 법 제54조의2제1항제6호에 따른 비전공상자: 별표 9 및 별표 10의 어느 하나에 해당하지 아니하는 상이자

② 법 제54조의2제2항 단서에서 "고의 또는 중과실로 사망하거나 위법행위를 원인으로 사망한 경우 등 대통령령으로 정하는 사유에 해당하는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <신설 2022.6.30>
