군인사법 시행령 제40조(휴직자에 대한 진급 발령의 보류)

① 진급 예정자가 휴직(진급 예정일 전에 복직하는 경우는 제외한다)되었을 때에는 복직될 때까지 진급 발령을 보류한다. <개정 2024.1.30>

② 진급권자는 제1항에 따라 진급 발령이 보류된 사람이 복직한 경우 복직한 날이 속하는 달의 다음 달부터 궐원이 발생한 달에 진급을 발령해야 한다. <신설 2024.1.30>
