군인사법 시행령 제33조(선발기준)

① 선발위원회는 진급 대상자가 진급될 계급에서 받을 직책을 수행할 수 있는 능력이 있는지를 심의하기 위하여 다음 각 호의 사항을 종합평가하고 그 결과에 따라 진급 대상자를 선발한다. <개정 2020.2.4, 2025.9.18>

② 합동참모의장은 장성급 장교의 진급 대상자 선발에 관한 의견서를, 방위사업청장 및 대령급 또는 3급 이상의 지휘관ㆍ부서장ㆍ기관장 중 국방부장관이 정하는 자는 소속 장교의 진급에 관한 추천서를 선발위원회에 제출할 수 있다. 이 경우 선발위원회는 해당 의견서 및 추천서의 내용을 제1항에 따른 선발기준에 추가하여 심의하여야 한다. <개정 2017.9.5, 2024.1.30, 2025.9.18>
