군인사법 시행령 제32조(선발 절차)

① 선발위원회는 진급 선발 대상자 중에서 진급 예정 인원에도 불구하고 차상위 계급에 진급될 자격을 갖춘 사람을 선발한다.

② 제1항에 따라 선발된 진급 자격자가 진급 예정 인원보다 적더라도 그 부족 인원을 보충하지 아니한다.

(2) Even이^v븐 where웨어 the^ð더 number넘버 of어^v브 qualified콸러^f파이드 promotees프^r러모우츠 selected설렉티드 under언더 paragraph패^r러그^r래^f프 (1) is이즈 smaller스몰러 than^ð댄 the^ð더 planned플랜드 number넘버 of어^v브 promotions,프^r러모우션즈 the^ð더 shortfall쇼트^f폴 shall섈 not낫 be비 filled.^f필드

③ 제1항에 따라 선발된 진급 자격자가 진급 예정 인원보다 많을 때에는 그 중에서 다시 진급 예정 인원을 선발하여야 한다. 이 경우 장성급 장교에 대한 진급 추천자를 선발할 때에는 진급 예정 인원 외에 후보자를 선발하여야 한다. <개정 2017.9.5>
