군인사법 시행령 제25조의2(임기제 진급 대상 직위 등)

① 법 제24조의2제1항에서 "인력 운영을 위하여 필요하거나 전문인력이 필요한 분야로서 대통령령으로 정하는 직위"란 다음 각 호의 어느 하나에 해당하는 직위를 말한다. <개정 2013.3.23, 2014.11.19, 2024.4.30>

② 장성급 장교의 임기제 대상 직위로의 진급은 「국방조직 및 정원에 관한 통칙」 제6조제3항에 따라 국방부장관이 배정한 해당 연도 장성급 장교의 정원표상의 직위와 일치되는 경우에만 실시한다. <개정 2017.9.5>

③ 제1항의 직위에 보직하기 위하여 법 제24조의2에 따라 진급되는 사람에 대해서는 임기제 진급자임을 표시하여 관리하여야 한다. 다만, 그 사람의 전역을 명할 때에는 임기제 진급자임을 표시하지 않는다. <개정 2026.8.3>

④ 참모총장은 법 제24조의2제2항 본문에 따른 전직 또는 재보직을 위하여 전직 또는 재보직 인원 등이 포함된 전직 또는 재보직 계획을 수립하여야 한다. <개정 2026.8.3>

⑤ 법 제24조의2제2항 본문에 따른 전직 또는 재보직은 제22조제2항에 따라 승인된 진급 예정 인원의 범위에서 제4항의 전직 또는 재보직 계획에 따라 한다. <개정 2026.8.3>

⑥ 법 제24조의2제2항 본문에 따른 전직 또는 재보직은 한 차례만 할 수 있으며, 참모총장의 추천을 받아 한다. <개정 2026.8.3>

⑦ 법 제24조의2제2항 본문에 따른 "유사한 계통의 직위"는 해당 임기제 진급자와 병과가 같거나 같은 전문 분야의 직무를 수행하는 직위로 한다. <개정 2026.8.3>

⑧ 임기제 진급자는 진급 후 최초로 보직된 직위에서 진급일을 기준으로 2년이 지나면 전역이 되는 것으로 하고, 직제 개편이나 그 밖의 불가피한 사유로 그 보직이 변경된 경우에도 임기 만료일은 진급일을 기준으로 한다.
