군인사법 시행령 제21조(장교진급 선발 대상권)

장교진급 선발 대상권(이하 "선발대상권"이라 한다)은 참모총장(해병대의 경우에는 해병대사령관을 말한다. 이하 이 조에서 같다)이 법 제29조제1항에 따른 장교진급 선발위원회의 회의에 부칠 대상자의 범위를 말한다. 이 경우 그 대상자는 진급 발령이 있는 날을 기준으로 법 제26조제1항 또는 제2항에 따른 진급 최저복무기간에 이른 사람으로 하되, 참모총장이 진급 비율을 조절하기 위하여 필요하다고 인정하는 경우에는 법 제26조제1항에 따른 진급 최저복무기간이 지난 사람 중에서 선임자의 순서로 대상자를 정할 수 있다.
