군인사법 시행령 제19조(진급 최저복무기간)

① 법 제26조에 따른 진급 최저복무기간의 계산은 제6조제2항 및 제4항을 준용하며, 진급 선발을 하는 해의 다음 해 12월 31일을 기준으로 한다.

② 법 제26조제2항에 따른 "인력 운영을 위하여 필요할 때"는 다음 각 호의 어느 하나에 해당하는 경우로 한다. <개정 2026.8.3>

③ 법 제26조제4항에 따라 외국 장교양성학교의 모든 과정을 이수함으로써 임용된 장교의 진급 최저복무기간은 소위에서 중위로 진급할 때에는 법 제26조제1항에 규정된 진급 최저복무기간의 2분의 1로 하고, 대위 이상 계급으로 진급할 때에는 국내 장교양성과정을 그와 같은 기(期)에서 이수하였던 사람의 진급과 균형을 유지하도록 단축할 수 있다.
