군용전기통신법 제8조(장애물의 제거 등)

① 국방부장관은 이동할 수 있는 인공구조물, 매설물(埋設物), 기기(器機), 죽목(竹木)이나 그 밖의 식물(이하 "인공구조물등"이라 한다)이 군용통신의 선로등을 설치하는 데에 장애가 되거나 군용통신의 전파장애를 일으키는 경우에는 그 소유자 또는 점유자에게 철거, 상태 변경, 벌채(伐採) 또는 이식(이하 "제거"라 한다)을 요구할 수 있다.

② 국방부장관은 인공구조물등의 소유자 또는 점유자가 제1항에 따른 요구에 따르지 아니하거나 인공구조물등을 제거할 수 없는 부득이한 사유가 있을 때에는 그 소유자 또는 점유자에게 미리 통지하고 인공구조물등을 제거할 수 있다. 이 경우 대통령령으로 정하는 인공구조물등에 대하여는 미리 관계 중앙행정기관의 장과 협의하여야 한다.

③ 제1항과 제2항의 경우에 인공구조물등의 소유자 또는 점유자의 주소나 거소가 분명하지 아니할 때에는 인공구조물등의 제거에 관한 사항을 대통령령으로 정하는 바에 따라 공고하여야 한다.
