군에서의 형의 집행 및 군수용자의 처우에 관한 법률 시행령 제134조(사망기록부)

① 군의관은 군수용자가 질병으로 사망한 경우에는 사망기록부에 병명, 병력(病歷), 사인 및 사망 일시를 기록하고 서명하여야 한다.

② 소장은 군수용자가 자살하거나 변사(變事)한 경우에는 그 사실을 즉시 군검사(기소된 군수용자인 경우에는 군사법원을 포함한다)에게 통보하고, 그 시신을 검사한 후 사망기록부에 검시자와 참여자의 성명, 신분 및 검시 결과를 기록하여야 한다. <개정 2014.10.28, 2022.6.30>

③ 소장은 법 제78조에 따라 사형을 집행하였을 때에는 사망기록부에 집행일시, 집행장소, 검시자와 참여자의 성명 및 유언이 있었는지를 기록하여야 한다.

④ 소장은 법 제113조에 따라 시신을 인도(引渡)하거나, 화장(火葬), 임시 매장 또는 합장(合葬)한 경우에는 그 사실을 사망기록부에 기록하여야 한다.
