군사정전에 관한 협정 체결 이후 납북피해자의 보상 및 지원에 관한 법률 제12조(피해위로금등의 지급신청)

①납북피해자 또는 그 유족으로서 이 법에 따른 정착금ㆍ피해위로금ㆍ보상금 또는 의료지원금(이하 "피해위로금등"이라 한다)을 지급받고자 하거나, 보호ㆍ지원을 받고자 하는 경우에는 대통령령이 정하는 바에 따라 관련 증빙서류를 첨부하여 서면으로 위원회에 피해위로금등의 지급 또는 보호ㆍ지원을 신청하여야 한다.

②제1항에 따른 피해위로금등의 지급신청 또는 보호ㆍ지원 신청은 납북피해자에 해당된 때(위원회의 심의를 거쳐 납북피해자로 결정된 때를 말한다)로부터 3년 이내에 신청하여야 한다. <개정 2018.12.24>

③위원회는 제1항에 따라 제출된 신청서 및 그 밖의 관련 증빙 자료에 미비한 사항이 있다고 판단되는 경우에는 신청인에게 보완이 필요한 사항 및 보완기간을 명시하여 이를 보완할 것을 요구할 수 있다.

④그 밖에 피해위로금등의 지급신청 또는 보호ㆍ지원 신청에 관하여 필요한 사항은 대통령령으로 정한다.
