군사법원법 제338조의3(피해자 등의 공판기록 열람ㆍ복사)

① 소송이 계속되어 있는 사건의 피해자(피해자가 사망하거나 심신에 중대한 장애가 있는 경우에는 배우자, 직계친족 및 형제자매를 포함한다), 피해자 본인의 법정대리인 또는 이들로부터 위임을 받은 피해자 본인의 배우자ㆍ직계친족ㆍ형제자매ㆍ변호사는 소송기록의 열람 또는 복사를 재판장에게 신청할 수 있다.

② 재판장은 제1항의 신청을 받으면 지체 없이 군검사, 피고인 또는 변호인에게 그 취지를 통지하여야 한다. <개정 2016.1.6>

③ 재판장은 피해자 등의 권리구제를 위하여 필요하다고 인정되거나 그 밖에 정당한 사유가 있는 경우에 범죄의 성질, 심리(審理) 상황, 그 밖의 사정을 고려하여 타당하다고 인정하면 열람 또는 복사를 허가할 수 있다.

④ 재판장은 제3항에 따라 복사를 허가하는 경우 복사한 소송기록의 사용 목적을 제한하거나 적당하다고 인정하는 조건을 붙일 수 있다.

⑤ 제1항에 따라 소송기록을 열람하거나 복사한 사람은 열람 또는 복사를 통하여 알게 된 사항을 사용할 때 부당하게 관계인의 명예나 생활의 평온을 해치거나 수사와 재판에 지장을 주지 아니하도록 하여야 한다.
