군사법원법 제249조(체포된 현행범의 인도)

① 군검사 또는 군사법경찰관리가 아닌 사람이 현행범을 체포한 경우에는 즉시 군검사나 군사법경찰관리에게 인도하여야 한다. <개정 2016.1.6>

② 군사법경찰관리는 현행범을 인도받았을 때에는 체포한 사람의 성명ㆍ주거 및 체포의 사유를 물어야 하고 필요하면 체포한 사람에게 군사법경찰관서에 동행할 것을 요구할 수 있다.
