고소 또는 고발에 따라 공소를 제기한 사건에 관하여 피고인이 무죄 또는 면소(免訴)의 판결을 받은 경우에 고소인 또는 고발인에게 고의 또는 중대한 과실이 있으면 그 고소인 또는 고발인에게 소송비용의 전부 또는 일부를 부담하게 할 수 있다.
