군사기밀 보호법 제22조(검사와의 협력 등)

① 「군사법원법」 제43조제2호 및 제46조제2호에 따른 군사법경찰관리는 이 법에 규정된 범죄에 관하여 「사법경찰관리의 직무를 수행할 자와 그 직무범위에 관한 법률」에서 정하는 바에 따라 사법경찰관리의 직무를 수행한다.

② 제1항에 따라 사법경찰관리의 직무를 수행하는 사람은 「군형법」의 적용을 받지 아니하는 피의자(이하 "피의자"라 한다)의 범죄를 수사할 때에는 검사의 지도ㆍ조언을 요청할 수 있다. <개정 2026.9.29>

③ 지방공소청장 또는 지청장은 피의자에 대한 불법구속 여부를 조사하기 위하여 필요하다고 인정할 때에는 소속 검사에게 관할구역 내에 위치한 군 수사기관의 피의자 구속장소를 점검하게 하며, 점검하는 검사는 피의자를 자세히 신문(訊問)하고 구속에 관한 서류를 조사할 수 있다. <개정 2026.9.29>

④ 검사는 피의자가 불법으로 구속된 것이라고 의심할 만한 상당한 이유가 있으면 즉시 해당 군 수사기관으로 하여금 구속된 자를 석방하게 하여야 한다. <개정 2026.9.29>
