군사기밀 보호법 제20조의2(몰수 및 추징 등)

① 이 법에 따른 죄를 범한 자 또는 그 정을 아는 제3자가 받은 해당 재산이나 이익은 몰수한다. 다만, 몰수가 불가능한 때에는 그 가액을 추징한다.

② 검사 또는 군검사는 이 법에 따른 죄를 범한 자에 대하여 소추를 하지 아니할 때에는 압수물 중 군사기밀에 해당하는 부분의 삭제나 폐기 또는 국고귀속을 명할 수 있다. <개정 2022.12.13>
