군복을 지급받은 자가 고의 또는 중대한 과실로 인하여 이를 잃어버리거나 헐어 못쓰게 되어 반납할 수 없게 된 때에는 그 가액을 변상하여야 한다. 이 경우 변상가액의 결정에 있어서는 군복의 사용기간 등을 참작하여 그 가액을 감액할 수 있다.
