군검찰 사건사무규칙 제48조(적부심보증금의 반환)

① 검찰서기는 적부심보증금의 반환 청구가 있는 때에는 반환사유를 확인하여 별지 제70호서식의 보관표의 명령란에 사유를 적고 군검사의 반환명령과 날인을 받아 별지 제68호서식의 적부심보증금 납입조건부 석방피의자 기록표와 별지 제69호서식의 적부심보증금 납입조건부 석방피의자 명부에 소정의 사항을 적은 후 별지 제70호서식의 보관표를 세입세출외 현금출납공무원에게 인계해야 한다. <개정 2022.7.12>

② 검찰서기는 적부심보증보험증권의 반환사유가 발생했음에도 30일 이내에 반환 청구가 없는 경우에는 별지 제70호서식의 보관표의 명령란에 군검사의 폐기명령과 날인을 받아 별지 제68호서식의 적부심보증금 납입조건부 석방피의자 기록표와 별지 제69호서식의 적부심보증금 납입조건부 석방피의자 명부에 정해진 사항을 적은 후 별지 제70호서식의 보관표를 유가증권 취급공무원에게 인계해야 한다. <개정 2022.7.12>
