국회법 제23조(국회의 예산)

① 국회의 예산은 독립하여 국가예산에 계상(計上)한다.

② 의장은 국회 소관 예산요구서를 작성하여 국회운영위원회의 심사를 거쳐 정부에 제출한다. 다만, 「국가재정법」에서 정한 예산요구서 제출기일 전일까지 국회운영위원회가 국회 소관 예산요구서의 심사를 마치지 못한 경우에는 의장은 직접 국회 소관 예산요구서를 정부에 제출할 수 있다.

③ 국회의 예산에 예비금을 둔다.

④ 국회의 예비금은 사무총장이 관리하되, 국회운영위원회의 동의와 의장의 승인을 받아 지출한다. 다만, 폐회 중일 때에는 의장의 승인을 받아 지출하고 다음 회기 초에 국회운영위원회에 보고한다.

⑤ 정부가 「국가재정법」 제40조제2항에 따라 국회 소관 세출예산요구액을 감액하기 위하여 국회의 의견을 구하려는 경우에는 그 감액 내용 및 사유를 적어 국무회의 7일 전까지 의장에게 송부하여야 한다.

⑥ 의장은 제5항에 따른 송부가 있은 때에는 그 감액 내용에 대한 의견서를 해당 국무회의 1일 전까지 정부에 송부한다.
