국제형사재판소 관할 범죄의 처벌 등에 관한 법률 제5조((지휘관과 그 밖의 상급자의 책임))

군대의 지휘관(지휘관의 권한을 사실상 행사하는 사람을 포함한다. 이하 같다) 또는 단체ㆍ기관의 상급자(상급자의 권한을 사실상 행사하는 사람을 포함한다. 이하 같다)가 실효적인 지휘와 통제하에 있는 부하 또는 하급자가 집단살해죄등을 범하고 있거나 범하려는 것을 알고도 이를 방지하기 위하여 필요한 상당한 조치를 하지 아니하였을 때에는 그 집단살해죄등을 범한 사람을 처벌하는 외에 그 지휘관 또는 상급자도 각 해당 조문에서 정한 형으로 처벌한다.
