국제형사재판소 관할 범죄의 처벌 등에 관한 법률 제4조((상급자의 명령에 따른 행위))

① 정부 또는 상급자의 명령에 복종할 법적 의무가 있는 사람이 그 명령에 따른 자기의 행위가 불법임을 알지 못하고 집단살해죄등을 범한 경우에는 명령이 명백한 불법이 아니고 그 오인(誤認)에 정당한 이유가 있을 때에만 처벌하지 아니한다.

② 제1항의 경우에 제8조 또는 제9조의 죄를 범하도록 하는 명령은 명백히 불법인 것으로 본다.
