국제수형자이송법 제14조(국내이송집행장의 발부)

①지방공소청장등은 제13조제1항에 따른 국내이송명령을 받은 때에는 지체없이 소속 검사로 하여금 국내이송에 필요한 조치를 취하도록 명하여야 한다. <개정 2009.3.25, 2026.3.24>

②검사는 제1항의 규정에 의하여 국내이송에 필요한 조치를 명령받은 때에는 지체없이 국내이송집행장을 발부하여 외국으로부터 국내이송대상수형자를 인도받고 그 자유형의 집행을 지휘하여야 한다.

③제2항의 규정에 의한 국내이송집행장에는 다음 각호의 사항을 기재하고 검사가 서명ㆍ날인하여야 한다.

④제2항의 규정에 의한 국내이송집행장에는 외국의 재판서 등본 또는 초본이나 그 밖에 판결이 선고되었음을 증명할 수 있는 서류를 첨부하여야 한다.

⑤제2항의 규정에 의하여 발부된 국내이송집행장은 형집행장과 동일한 효력이 있다.

⑥형사소송법 제1편제9장중 피고인의 구속에 관한 규정은 국내이송집행장의 집행에 관하여 이를 준용한다.
