국민의 형사재판 참여에 관한 법률 제10조(지방법원 지원 관할 사건의 특례)

① 제8조에 따라 피고인이 국민참여재판을 원하는 의사를 표시한 경우 지방법원 지원 합의부가 제9조제1항의 배제결정을 하지 아니하는 경우에는 국민참여재판절차 회부결정을 하여 사건을 지방법원 본원 합의부로 이송하여야 한다.

② 지방법원 지원 합의부가 심판권을 가지는 사건 중 지방법원 지원 합의부가 제1항의 회부결정을 한 사건에 대하여는 지방법원 본원 합의부가 관할권을 가진다.
