국민건강보험법 시행규칙 제38조(부담금 등)

① 법 제67조제1항에 따른 부담금(이하 이 조에서 "부담금"이라 한다)은 법 제36조 및 제68조에 따라 보건복지부장관이 승인한 심사평가원의 예산에 계상(計上)된 금액으로 하되, 공단의 전전년도 보험료 수입의 1천분의 30을 넘을 수 없다.

② 법 제67조제2항에 따른 수수료는 심사평가원 원장이 업무를 위탁한 자와 계약으로 정하는 금액으로 하되, 의료급여비용 심사에 관한 비용은 보건복지부장관이 정하는 바에 따른다.

③ 심사평가원은 부담금이 회계연도가 시작되기 전까지 확정되지 아니한 경우에는 전년도 부담금에 준하여 해당 연도 부담금을 징수하고 부담금 확정 후 정산한다.

(3) Where웨어 the^ð더 charges차지즈 have해^v브 not낫 been빈 determined디터먼드 before비^f포 the^ð더 beginning비기닝 of어^v브 the^ð더 fiscal^f피스클 year,이어 the^ð더 Review^r리^v뷰 and앤드 Assessment어세스먼트 Service서^v비스 shall섈 collect컬렉트 the^ð더 charges차지즈 for^f포 the^ð더 relevant^r렐러^v번트 year이어 in인 accordance어코든스 with위^ð드 the^ð더 charges차지즈 of어^v브 the^ð더 previous프^r리^v비어스 year이어 and앤드 settle세틀 them^ð뎀 after애^f프터 the^ð더 charges차지즈 are아 determined.디터먼드

④ 심사평가원은 부담금을 분기별로 징수하고, 제2항에 따른 수수료는 월별로 징수한다.

(4) The^ð더 Review^r리^v뷰 and앤드 Assessment어세스먼트 Service서^v비스 shall섈 collect컬렉트 charges차지즈 quarterly쿼털리 and앤드 the^ð더 fees^f피즈 under언더 paragraph패^r러그^r래^f프 (2) monthly.먼^θ슬리

⑤ 부담금 및 수수료의 징수ㆍ납부 절차 및 방법 등에 관하여 필요한 사항은 보건복지부장관이 정하는 바에 따른다.
