Enforcement Decree of the Act on the Establishment and Operation of Seoul National University as a National University Corporation, Article 9 (Management and Protection of Property)
① 법 제21조제1항 본문에서 "대통령령으로 정하는 것"이란 교사 및 교지를 제외하고 교육ㆍ연구에 사용되는 재산을 말한다.
(1) "Property prescribed by Presidential Decree" in the main text of Article 21 (1) of the Act means property used for education and research, excluding school buildings and sites.
② 법 제21조제1항 단서에서 "대통령령으로 정하는 가액ㆍ면적ㆍ규모 등을 고려한 경미한 사항"이란 다음 각 호의 어느 하나에 해당하는 사항을 말한다.
(2) "Minor matters in consideration of value, area, scale, etc. prescribed by Presidential Decree" in the proviso to Article 21 (1) of the Act means any of the following:
1. 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」에 따른 협의 또는 수용에 의한 처분
1. Disposition by agreement or expropriation under the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects;
2. 10억원 미만의 가액 한도에서 하는 매도, 증여, 교환, 용도변경 또는 담보 제공
2. Sale, gift, exchange, change of use or provision as security within a value limit of less than 1 billion won.
③ 교사 및 교지는 법 제21조제2항에 따라 매도ㆍ증여하거나 담보로 제공할 수 없다. 다만, 학교 이전 또는 시설 노후 등 불가피한 사유로 인하여 교육ㆍ연구 용도로 사용할 수 없는 경우에는 교육부장관의 승인을 받아 교환하거나 용도변경할 수 있다. <개정 2013.3.23>
(3) School buildings and sites may not be sold, donated or provided as security under Article 21 (2) of the Act. However, where they cannot be used for education and research due to unavoidable reasons such as relocation of the school or aging of facilities, they may be exchanged or have their use changed with approval of the Minister of Education.
